My Databoss Acceptable Use Policy

You (you or your) must comply with this Acceptable Use Policy in connection with your agreement with My Databoss Pty Ltd (“My Databoss”, “we”, “us” or “our”) to access the My Databoss identity verification and related services (“Services”).
Definitions
For the purposes of this Acceptable Use Policy:
“Relying Party User” means any individual authorised by a business customer of My Databoss to access and use the Services, including for the purposes of initiating identity verification of End Users.
“End User” means an individual whose identity is verified through the Services at the request of a Relying Party User, and who may also provide or share documents, contact details or other data with a Relying Party User through the Services.
“Services” means the identity verification and related services provided by My Databoss, including access to the My Databoss platform and any associated tools, integrations, and third-party verification services.
1. Scope of Use
1.1 You must only use the Services:
(a) for their intended purpose; and
(b) as directed by My Databoss from time to time.
1.2 You must ensure that any identity-related data uploaded to the platform is accurate, lawful, and pertains solely to your own identity.
1.3 The upload of identity-related data on behalf of others, including third parties, is strictly prohibited unless expressly authorised by the platform and accompanied by evidence of the data subject’s explicit consent.
1.4 The Services must only be used for lawful purposes, including but not limited to:
(a) verifying personal identities for legitimate business or regulatory needs; and
(b) complying with applicable laws including but not limited to Anti-Money Laundering (AML), Counter-Terrorism Financing (CTF), and “Know Your Customer” (KYC) requirements.
2. Prohibited Activities
You must not use the Services to:
2.1 Post, upload, or otherwise make material available that is:
(a) fraudulent, altered, or unauthorised identity information, including but not limited to tampered documents or fabricated identities;
(b) illegal, obscene, defamatory, harassing, abusive, tortious, hateful, invasive of privacy, or racially or otherwise objectionable, discriminatory, or offensive;
(c) infringing any intellectual property or industrial property rights of My Databoss or any third party (including material that infringes copyrights, trademarks, patents, or trade secrets); or
(d) in violation of any applicable law, or in a manner that causes My Databoss to breach any law.
2.2 Fraudulently or otherwise misrepresent:
(a) yourself to be another person or a representative of another entity, including a My Databoss representative; or
(b) your affiliation with a person, entity, or group.
2.3 Bypass or attempt to bypass any fraud detection mechanisms or other security features implemented by My Databoss.
2.4 Use verified identity data for unauthorised purposes, such as profiling, marketing, or any non-verification activities, without the explicit consent of the data subject.
2.5 Collect or aggregate identity data beyond the scope of the identity verification process.
2.6 Post, upload, or make available:
(a) content containing malware, viruses, or any other material designed to impair, destroy, or interrupt hardware or service performance; or
(b) spam, junk mail, chain letters, or any other unauthorised advertising or promotional materials.
2.7 Access, or attempt to access:
(a) password-protected areas or accounts not expressly authorised for you; or
(b) the underlying infrastructure, systems, and software used by My Databoss to provide the Services.
3. Consent and Data Rights
3.1 Relying Party Users must complete identity verification to access the Services and consent to My Databoss processing their identity data for authentication, account security, and regulatory compliance.
3.2 End Users consent to their identity data being collected, processed, and shared with the relevant Relying Party for the sole purposes of identity verification, compliance with AML, CTF, KYC, and related regulatory reporting.
3.3 By submitting identity data, both Relying Party Users and End Users grant My Databoss a limited licence to use the data solely for providing the Services, maintaining verification records, audit logs, and complying with applicable law.
3.4 My Databoss engages third-party providers (such as RapidID and MetaMap) to process identity data. Users consent to such processing as part of the Services.
3.5 End Users may also, through the platform, provide or share documents, contact details, and other data with Relying Party Users in response to their lawful requests. Such sharing is expressly authorised by the End User and forms part of the Services.
4. Data Protection and Privacy
4.1 You must comply with all applicable data protection laws, including but not limited to the Australian Privacy Act, GDPR, and CCPA, in your use of the Services.
4.2 You are responsible for maintaining the confidentiality and security of all identity data uploaded to the platform.
4.3 My Databoss will retain identity-related data only for the duration necessary to fulfil the verification and compliance obligations of Relying Parties. Data will be securely deleted after this period unless otherwise required by law.
5. Monitoring and Enforcement
5.1 My Databoss reserves the right to:
(a) monitor identity verification activities for compliance with this policy and applicable regulations;
(b) remove any content or data found to violate this policy or applicable laws; and
(c) flag and investigate suspicious activities and report violations to relevant regulatory authorities where required.
5.2 Any breach of this policy may result in:
(a) immediate suspension or termination of Services; and
(b) removal of uploaded data or content.
6. Responsibilities of Users
6.1 You are responsible for:
(a) ensuring all uploaded identity data is accurate and free from tampering;
(b) protecting your data and maintaining backups of information uploaded to the Services; and
(c) ensuring compliance with all applicable laws, including obtaining necessary licences for specific activities related to identity verification.
6.2 You must immediately notify My Databoss of any suspected security breaches, unauthorised access, or misuse of the Services.
7. Service Integrity
7.1 My Databoss employs advanced fraud detection tools, including AI and document authenticity checks, to ensure the integrity of the Services.
7.2 You must not:
(a) submit fraudulent documents or identities for verification; or
(b) interfere with or disrupt the normal operation of the Services, including through excessive bandwidth usage or high-volume requests intended to overwhelm the platform.
7.3 My Databoss reserves the right to charge for excess bandwidth usage caused by high-content uploads or activities exceeding standard operational thresholds.
8. Amendments to the Policy
8.1 My Databoss reserves the right to update this Acceptable Use Policy periodically. Any revisions will be posted on the My Databoss website, and users are encouraged to review the policy regularly to remain informed about any changes.

By accessing or using the Services, you confirm that you have read, understood, and agree to abide by the terms outlined in this Acceptable Use Policy.
